Welcome to AtMealTime (hereinafter referred to as "the Service"). Please read these Terms of Service ("Terms") carefully before using the Service. By using the Service, you agree to comply with these Terms. If you do not agree to these Terms, you must not use the Service.

Please read this document carefully. If you sign up for, access or use our Services, you agree to this Agreement. Please do not use the Services if you are under 13 of age or barred from doing so under applicable law.

Description of Services

The Service uses AI technology to recognize your menu and generate digital menu images based on the provided content. Users can upload menu images, text, or other input formats to generate menu images for display or sharing purposes. Please note that the Service primarily functions as a translation and suggestion tool and does not provide any medical advice.

Age Requirements

To use AtMealTime, you must be over 13 years old. If you are based in the United States or any country with similar regulations, you may only use AtMealTime Services if you are over the age at which you can provide consent to personal data processing under the laws of your country, or if verifiable parental consent has been provided to us.

User Rights and Responsibilities

• Legal Use: You agree to use the Service only for lawful purposes and not engage in any illegal, infringing, or harmful activities.
• User Content: You are solely responsible for any menu images and related data (such as menu items, images, descriptions, etc.) you upload. You represent and warrant that you have all necessary rights to upload such content and that it does not infringe any third-party rights.
• License Grant: You grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, publish, and distribute your uploaded content for the purposes of providing, maintaining, and improving the Service.
• Indemnification: You agree to indemnify and hold us harmless from any claims, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of your violation of these TOS or any applicable laws.

Image Usage and Copyright

• Use of Non-Private Images: If the menu images you upload do not contain any private or sensitive information, you agree that we have the right to use the generated images for purposes including but not limited to marketing, advertising, promotion, and market research. By uploading non-sensitive images, you understand and agree that such images may be used publicly or to improve the Service.
• Content Source and Usage: The images and content displayed on our Service are collected from the internet and generated by AI models, serving solely for display and illustrative purposes. While we make every effort to respect intellectual property rights, if you find any content that you believe infringes your rights, please contact us at service@group-ultra.com for prompt removal. As we collect content from public sources for educational and demonstrative purposes only, this usage is intended to be fair use and does not constitute copyright infringement. Nevertheless, we will address any concerns promptly upon notification.
• Privacy Data Handling: The Service will protect users' privacy and data security. We will not use images containing sensitive information for unauthorized purposes. Our Privacy Policy will detail how we collect, use, and protect user data.

AI-Generated Content Disclaimer

The Service utilizes AI models to generate images and information, including but not limited to allergens, calorie information, and dish descriptions. We do not guarantee the accuracy, completeness, or reliability of any AI-generated content. The AI-generated images and information are provided for display purposes only and should not be relied upon for any purpose, including dietary, medical, or health-related decisions.

• No Medical Advice: The Service does not provide medical advice. Any health-related information provided by the Service is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.
• Limitation of Liability for AI Content: We are not responsible for any harm, loss, or damage arising from your reliance on AI-generated content provided by the Service.

Restrictions and Prohibited Uses

• Prohibited Content: You may not upload images or text that contain personal sensitive information, copyrighted content, hate speech, illegal activities, harmful content, or any illegal or inappropriate material.
• Misuse of Service: You must not misuse the Service by engaging in spamming, malicious attacks, or other activities that may disrupt or damage the normal operation of the Service.

Privacy Policy

Disclaimers and Limitation of Liability

• Service Provided "As Is": The Service is provided on an "as is" and "as available" basis. We make no express or implied warranties regarding the accuracy, completeness, reliability, suitability, or availability of the Service.
• No Warrant on Content: We do not warrant that the content generated or displayed by the Service, including AI-generated images and information, is accurate, reliable, or error-free.
• Limitation of Liability: To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use or inability to use the Service. In any case, our total liability to you shall not exceed the amount you have paid us for the use of the Service in the twelve (12) months preceding the claim.

Force Majeure

We shall not be liable for any delay or failure to perform due to causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, government actions, or network failures.

Modifications and Termination

• Modification of Terms: We reserve the right to modify or update these Terms at any time. The updated Terms will become effective upon publication and will replace any previous versions. Continued use of the Service constitutes acceptance of the updated Terms.
• Termination of Service: We may suspend or terminate a user's access to the Service at any time, particularly if the user violates these Terms.You may stop using the service at any time. Governing Law and Dispute Resolution

Severability

If any provision of these TOS is found to be illegal, void, or unenforceable, such provision shall be deemed severable from these TOS and shall not affect the validity and enforceability of the remaining provisions.

Entire Agreement

These TOS constitute the entire agreement between you and us regarding the Service and supersede all prior or contemporaneous understandings and agreements, whether written or oral, relating to the Service.
